Call to Order
 
The Common Council of the City of Bedford, Indiana met in regular session on Tuesday, July 12th, 2011 at 7:00 PM in the Council Chambers of Bedford City Hall. The Honorable Mayor Shawna M. Girgis presided and called the meeting to order. The following members were present for the meeting:

Reading of the June Minutes
·       Byron Buker made a motion to accept the minutes of the June 14th, 2011 meeting and Mark Scherschel seconded the motion. All the members voted in favor. No one opposed. Passed
Old Business
1.      Ordinance 7-2011 As Amended – Ordinance Establishing The Addition To The Existing Bedford Courthouse Square Historic District (Map Attachment )- Dan Kirk, Rowena Cross-Najafi, and Mary Margaret Stipp
The original Ordinance 7-2011 that was passed twice (2) on the June 14th, 2011 City Council Meeting did not contain the classifications required. The original Ordinance 7-2011 dies for lack of a motion.  
 
·       Byron Buker made the motion to approve the first passage of Ordinance 7-2011 As Amended and Michele Murphy seconded the motion. All votes in favor no one opposed.Passed
 
·       Patrick Robbins motioned for the 2nd passage and Kelly Cobb seconded the motion. All votes were in favor no one opposed.Passed
 
·       Byron Buker motioned to suspend the rules and vote for 3rd and final passage and Judy Carlisle seconded the motion. Again all votes were in favor of the motion no one opposed.Passed
 
·       Kelly Cobb made the motion to approve the 3rd and final passage of Ordinance 7-2011 As Amended and Byron Buker seconded the motion. All votes were in favor of the motion and no one was opposed.Passed
 
2.      Ordinance 8-2011 – Ordinance Vacating Alleyway – Doris Dalton
Whereas, Doris M. Dalton filed with the City Council a petition to vacate an alleyway which said alleyway is more particularly described as follows:
Beginning at the southeast corner of Lot Numbered Two (2) in Hawthorn Addition to the City of Bedford, Lawrence County, Indiana, thence West along the south lines of Lots Numbered Two (2) and One (1) in said Hawthorn Addition to the southwest corner of said Lot One (1), thence South to the northwest corner of Lot Numbered Sixty-Six (66) and Sixty-Five (65) in said Hawthorn Addition to the northeast corner of said Lot Sixty-Five (65), thence North to the place of beginning.
And, whereas, notice of the filing of the said petition and the hearing thereon was duly published pursuant to law.
The City has found located under the alleyway a water line owned by the City of Bedford and that a vacation of the alleyway should be subject to an easement in favor of the City of Bedford.
·       Byron Buker made the motion to approve the first passage of Ordinance 8-2011 Continent upon an amendment whereby the Owner grants permission for an easement to the City for existing water lines.Patrick Robbins seconded the motion. All votes in favor no one opposed.Passed
 
·       Patrick Robbins motioned for the 2nd passage and Judy Carlisle seconded the motion. All votes were in favor no one opposed.Passed
 
·       Byron Buker motioned to suspend the rules and vote for 3rd and final passage and Michele Murphy seconded the motion. Again all votes were in favor of the motion no one opposed.Passed
 
·       Kelly Cobb made the motion to approve the 3rd and final passage of Ordinance 8-2011 As Amended and Julie Johnson Hewetson seconded the motion. All votes were in favor of the motion and no one was opposed.Passed

1.     Compliance With Statement Of Benefits – General Motors LLC – Personal Property – Castings And Related Machinery & Equipment (Resolution 12-2003) – Glenn Sampson, Troy Kennedy
 
2.     Compliance With Statement Of Benefits – General Motors LLC – Personal Property – Castings And Related Machinery & Equipment (Resolution 4-2006) – Glenn Sampson, Troy Kennedy
 
3.      Compliance With Statement Of Benefits – General Motors LLC – Personal Property – Die Casting, Automation & Related Foundry Equipment (Resolution 4-2007) – Glenn Sampson, Troy Kennedy
 
·        Patrick Robbins made the motion to accept the three (3) Compliance with Statement of Benefits /Personal Property filed by General Motors LLC and Mark Scherschel seconded the motion.  All votes were in favor of the motion. Passed
 
4.      Resolution 3-2011 – Authorizing The Filing Of Application For Grant Under Section 5311 Of The Federal Transit Act – Melanie Hacker
 
Resolution 3-2011 authorizes the Mayor of the City of Bedford, Shawna M. Girgis to execute and file an application on behalf of the City of Bedford with INDOT to aid in financing of transit assistance projects pursuant to Section 5311 of The Federal Transit Act, as amended.
 
That Shawna M. Girgis, Mayor of the City of Bedford is authorized to furnish such additional information as INDOT may require in connection with the application.
 
That Shawna M. Girgis, Mayor of the City of Bedford is authorized to execute grant contract agreements as well as grant administration and management contracts on behalf of the City of Bedford.
 
·        Mark Scherschel motioned to approve Resolution No. 3-2011 and Kelly Cobb seconded the motion. All votes were in favor no one opposed. Passed
 
 
5.      Resolution 4-2011 – Supporting Merger Of AT&T And T-Mobile USA – Gene McCracken
Director of the Lawrence County Economic Growth Council, Gene McCracken, stated that the proposed merger between AT&T and T-Mobile has brought great news that Lawrence residents who live in rural areas will no longer be left behind by wireless companies who in the past have chosen to skip over our area when deciding where to build their wireless networks. He states that there are many economic benefits too. Mr. McCracken said that we want the people who live, work and visit here to have access to this wireless technology so they can invest in our economy and create jobs.
·        Patrick Robbins motioned to approve Resolution No. 4-2011 and Julie Johnson Hewetson seconded the motion. All votes were in favor no one opposed. Passed
 
6.     Ordinance 10-2011 – Travel (Amending Ordinance 15-2005)
Clerk/Treasurer Julie Chase stated that Ordinance 10-2011 eliminates No. 11 “Certification for Missing Receipt Form” from the City of Bedford’s Travel Policy. The form is not a State Board of Accounts prescribed form and therefore it needs to be omitted from the policy.

7.      Ordinance 11-2011 – Approving Base Salaries For Police, Firefighters, Appointive Officials And Employees, And Approving Additional Compensation Of Elected And Appointed Officials For The Year 2012
Kyle Brown told the council that the base salaries for police, firefighters, appointed officials and employees and additional compensation of elected and appointed officials for the year 2012 stay the same as the current year 2011.
·       Byron Buker made the motion to approve the first passage of Ordinance 11-2011 and Mark Scherschel seconded the motion. All votes in favor no one opposed.Passed
 
·       Patrick Robbins motioned for the 2nd passage and Kelly Cobb seconded the motion. All votes were in favor no one opposed.Passed
The 3rd and final passage will take place at the next city council meeting.
 
8.      Ordinance 12-2011 – Establishing The Salaries Of Elected Officials For The Year 2012
 
Kyle Brown states that the salaries of elected official for the City of Bedford for the year 2012 stays at the 2011 rate.
 
·       Byron Buker made the motion to approve the first passage of Ordinance 12-2011 and Julie Johnson Hewetson seconded the motion. All votes in favor no one opposed.Passed
 
·       Mark Scherschel motioned for the 2nd passage and Judy Carlisle seconded the motion. All votes were in favor no one opposed.Passed
 
The 3rd and final passage will take place at the next city council meeting.
 
9.      Ordinance 13-2011 – Amending Animal Ordinance 4-2011
 
City Attorney Greg Pittman said that some of the changes to Ordinance 4-2011 are:
 
·        The old Ordinance states that an animal owner must request a hearing of the Animal Control Commission before his or her animal is declared a “dangerous animal’.  The new Ordinance states that the animal owner receives a hearing and doesn’t have to request one from the commission. Written notice of such declaration shall be served personally upon the owner, or their authorized agent, or served by mailing the notice, by certified or registered mail, return receipt requested, upon the owner or his authorized agent. The notice shall indicate that the animal is declared to be a dangerous animal and shall designate the date, time, place, and purpose of a hearing before the animal control commission.
 
·        Changes the days from (30) to (7) of the date of the Commission’s Order the owner fails or refuses to comply with the directives of the Commission, the animal may be humanely euthanized pursuant to the rules and regulations of the animal shelter where the animal is impounded without notice or further action by the commission.

·       Michele Murphy made the motion to approve the 3rd and final passage of Ordinance 13-2011 and Kelly Cobb seconded the motion. All votes were in favor of the motion and no one was opposed.Passed
 
 
10. Ordinance 14-2011 – Amending Part Of Chapter 77 Parking Schedules
 
ORDINANCE NO. _14____ - 2011
AN ORDINANCE AMENDING PART OF CHAPTER 77
PARKING SCHEDULES, OF THE CITY CODE
OF 1983 (AS AMENDED)
       
                    BE IT ORDAINED by the Common Council of the City of Bedford, Indiana as follows:
                    Section 1. That Schedule I(C) Two-Hour Parking. of Chapter 77: Parking Schedules of the City Code of 1983, as amended, be and the same hereby is amended by adding the following two hour parking spaces:

Nine                                                                        West side of K Street, north from 14th Street to the alley.
Seven                                                                     East side of K Street, north from 14th Street to the alley.                    
                   
Section 2. Unless specifically modified herein, all other parts of Schedule I(C) of Chapter 77 of the Bedford City Code shall remain in full force and effect.
                    Section 3. That this ordinance shall be in full force and effect from and after its passage by the Common Council of the City of Bedford and approval by the Mayor in the manner provided by law.

There was a question of who represents the City Council on the Animal Control Commission?
Answer: Kelly Cobb was appointed to that commission. The members of the commission are as follows:
